Business Interruption Insurance in relation to closures and losses during COVID-19 has been a contentious issue and we have been keeping a close eye on current developments

The validity of exclusions in policies is being challenged.

The validity of this exclusion in some policies is being challenged overseas, and Australia is set to follow. The Australian Financial Complaints Authority and Insurance Council of Australia are set to file a test case.  They will seek a decision on whether references to a quarantinable disease should be construed as a reference to a listed human disease under the Biosecurity Act 2015 in various policies with business interruption coverage.

The outcome will assist with complaints arising from claims.

Complaints arising out of Business Interruption Insurance claims are already happening. Insurers maintain that the intention of pandemic and communicable human disease exclusions are clear however only the courts will be able to provide ultimate clarity on the issue. Logans will continue to closely monitor the outcomes of these test cases – both overseas and in Australia and will keep you updated as to how it may affect any potential claim.
