As previously advised to our clients, we have been watching a recent test challenge undertaken by the Australian Financial Complaints Authority and the Insurance Council of Australia in the NSW Court of Appeal, that was done to fast track potential uncertainty surrounding an issue of coverage for Business Interruption under certain business insurance policies.
The policies in question refer to a since repealed legislation – the Quarantine Act (1908) instead of the correct legislation, the Biosecurity Act (2015).
The test case recently found in favour of the insureds and determined that the insurers could not rely on the exclusion to pandemics where the exclusion refers incorrectly to the Quarantine Act. This means claims that have been denied on this basis, or claims that have not been submitted because of it, could have success claiming business interruption as a result of COVID-19.

But is isn’t over yet. Insurers have, not surprisingly, maintained that business interruption was never intended to cover a pandemic situation, and that the policies were not priced to cover such events. They are now challenging the decision in the High Court – so we continue to advise “watch this space”.
There is likely to be a further test case to be conducted to explore other policy issues that have been raised with insurers such as what constitutes a “prevention of access”. These parameters have not yet been finalised but we will be sure to keep watch on this as well.

The Mental Wheels Tour was held on 19-21 November this year. A road bike ride that brings people together, taking action to directly improve mental well-being.
Over 3 days the Tour covered more than 380km including the NSW Southern Highlands, the famous Jenolan Caves and Bathurst’s iconic Mt Panorama.
